Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Search Analytics Dashboard and any related websites, APIs, mobile applications and services provided by QueryBurst (collectively, the "Service"). By registering an account, connecting a Google Search Console property, or otherwise using the Service, you agree to be bound by these Terms.

QueryBurst operates in the United Kingdom from 46 Abbot Street, Perth, UK, PH2 0EE ("QueryBurst", "we", "us", or "our"). If you do not agree with these Terms, do not use the Service.

1. Definitions

Account: The user profile created to access the Service.
Content: Any data, text, graphics or other material uploaded to or processed by the Service, including Google Search Console data.
Documentation: Any online or in-product help resources describing the Service.
Subscription: The paid or free-tier plan under which you access the Service.

2. Eligibility & Account Registration

You must be at least 18 years old and have authority to bind the entity you represent.

You agree to provide accurate information and keep your Account credentials secure. You are responsible for all activities conducted through your Account.

3. Licence & Acceptable Use

Limited licence. Subject to these Terms, QueryBurst grants you a non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes.

Prohibited actions. You will not:

copy, modify, reverse engineer or create derivative works of the Service;
use the Service to infringe third-party rights, transmit unlawful content, or perform security testing without permission;
exceed the API rate limits or attempt to bypass technical restrictions; or
use the Service to build a competing product.

4. Third-Party Services

Google OAuth & Search Console. Connecting a property requires authenticating via Google OAuth 2.0 and granting the webmasters.readonly scope. Your use of Google services is governed by Google's terms. Our use of Google API data complies with the Google API Services User Data Policy and its Limited Use requirements.

Hosting & infrastructure. The Service is hosted on DigitalOcean in the New York region. While QueryBurst controls the application, we do not guarantee continuous availability of DigitalOcean or other sub-processors.

5. Subscriptions, Fees & Payment

Plans. Details of each Subscription plan (usage limits, features, prices) are set out on our pricing page. Free-tier accounts may have reduced functionality.

Billing & payment processing. Fees are billed in advance and are non-refundable except as required by law. All card payments are processed by Stripe Payments Europe, Ltd. ("Stripe"). You authorise QueryBurst and Stripe to charge your selected payment method on each renewal date unless you cancel beforehand. QueryBurst does not store your full card details; Stripe processes them in accordance with the Payment Card Industry Data Security Standard (PCI-DSS).

Changes. We may adjust prices or plan limits with at least 30 days' notice.

6. Intellectual Property

Service IP. QueryBurst and its licensors retain all intellectual-property rights in the Service and Documentation.

Customer Data. You retain all rights in your Content. You grant QueryBurst a licence to use, host, and process Content solely to provide and improve the Service.

Feedback. You may provide feedback or suggestions; we may use them without restriction or compensation.

7. Confidentiality

Each party agrees to protect any confidential information of the other party and use it only as permitted under these Terms.

8. Data Protection & Security

Processing of personal data is governed by our Privacy Policy, which forms part of these Terms. You acknowledge that the Service processes and stores data in accordance with that policy and applicable law.

9. Availability & Support

We aim for 99.5% monthly uptime, excluding scheduled maintenance or factors outside our control (e.g. force majeure, DigitalOcean outages, Google API downtime).

Standard support is available via email ([email protected]) during UK business hours.

10. Suspension & Termination

By you. You may cancel your Subscription at any time via the dashboard; termination is effective at the end of the current billing cycle.

By us. We may suspend or terminate your access immediately if you breach these Terms, law, or cause security risks. We will use reasonable efforts to give notice.

Data export. Upon termination, you can export your Content for 30 days. After that period, we may delete it.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, QueryBurst disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

Indirect damages. QueryBurst will not be liable for any indirect, incidental, special or consequential damages, including lost profits or data.

Aggregate cap. QueryBurst's total liability under these Terms will not exceed the fees paid by you to QueryBurst in the 12 months preceding the event giving rise to liability.

Exclusions. Nothing limits liability for death, personal injury, or any matter that cannot be excluded by law.

13. Indemnification

You will indemnify and hold QueryBurst harmless from any claim arising from your Content or breach of these Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Scotland. The courts of Scotland have exclusive jurisdiction, except that QueryBurst may seek injunctive relief in any jurisdiction.

15. Changes to these Terms

We may revise these Terms from time to time. Material changes will be notified via email or dashboard at least 30 days before they take effect. Continued use of the Service after such date constitutes acceptance.
